1. Nature of the service (critical)
1.1 Bayatoo is a purchase intermediary.
You provide product links from third-party stores (including but not limited to SHEIN, Temu, and iHerb). We review, quote, and—after your confirmation—purchase and arrange delivery on your behalf.
1.2 Bayatoo is not:
- the seller of record of those third-party products in the same sense as the original store;
- a marketplace where independent merchants list inventory on our platform;
- a clone of SHEIN, Temu, or iHerb.
1.3 Product availability, descriptions, and original pricing on third-party sites can change without notice. Our quote reflects our assessment at the time of quoting and may differ from the storefront page.
1.4 Images or titles fetched from product URLs are for identification convenience only and may be incomplete or outdated.
2. Eligibility
2.1 You must be able to enter a valid customer relationship (typically 18 years or older) and provide accurate information.
2.2 Service is oriented to customers and delivery in Jordan unless we expressly agree otherwise.
2.3 We may refuse service for prohibited items, unsupported destinations, fraud risk, or operational limits.
3. Account and authentication
3.1 Accounts use an email address or mobile number, plus a password. Keep your password to yourself: anyone who has it can place orders as you.
3.2 You are responsible for the confidentiality of your device and for activity under your verified phone number.
3.3 You must provide accurate name, city, and delivery details when required.
3.4 Guest use may be available for browsing and cart building; sending for pricing and full order tracking require a signed-in account as implemented in the app.
4. Cart, quotes, and confirmation
4.1 Cart: You may add product links and notes (size, color, quantity, etc.). Notes are instructions to us; we may still need to contact you if information is insufficient.
4.2 Send for pricing: Submitting a cart creates an order under review. This is a request for a quote, not a completed purchase from the third-party store.
4.3 Quote: When ready, we present amounts (e.g. products subtotal, delivery fee, discounts, total) and a validity period where applicable.
Until you confirm, we are generally not obliged to purchase the items.
4.4 Material changes: If the quote changes materially before confirmation, you should re-review. We may notify you when such changes occur under our notification policy.
4.5 Confirmation: By confirming, you accept the quote (as shown) and authorize us to proceed with purchase and delivery arrangements, subject to availability and these Terms.
4.6 Payment method: Orders are paid cash on delivery (COD). COD may be subject to exposure limits (e.g. outstanding COD balances). Where those limits or risk require it, we may decline to accept or to continue an order.
4.7 Quote expiry: If you do not confirm within the stated validity window, the quote may expire and the order may be closed or returned for re-pricing as implemented.
5. Fulfillment, shipping, and delays
5.1 After confirmation we use reasonable efforts to purchase and ship. Times are estimates, not guaranteed delivery dates, unless we state a firm commitment in writing.
5.2 Third-party stock, customs, carriers, and force majeure events may delay or prevent completion.
5.3 You must provide a reachable delivery address and phone. Failed delivery due to incorrect details may incur extra cost or cancellation under our policies.
5.4 We may mark items unavailable, adjust active lines, or cancel the order when fulfillment is impossible (see also cancellation rules).
6. Cancellations and inability to complete
6.1 You may cancel in situations the app allows (e.g. rejecting a quote, or cancel within a stated window).
6.2 We may cancel for policy, fraud, prohibited goods, incomplete required information after a reasonable deadline, or operational refusal.
6.3 Could not complete: If items cannot be purchased or delivered despite reasonable efforts (e.g. out of stock, invalid link, source restrictions), we may close the order as unable to complete and inform you.
6.4 Refunds or adjustments of amounts already paid (if any) are handled case-by-case according to payment status and residual costs already incurred. No cash “withdrawal” of promotional balances applies.
7. Pricing and Bayatoo fees
7.1 Displayed third-party prices on external sites are not automatically our final selling prices.
7.2 Our quote includes the amounts we charge you for the service package (products as priced by us, delivery, and any stated discounts).
7.3 Taxes, customs, or extra fees—if applicable—will be handled as disclosed in the quote or subsequent communication.
8. Bayatoo Points and Bayatoo Credit
8.1 Bayatoo Points are earned on your account: welcome points when you first register, points for eligible share activity, and points on orders you successfully receive. Points for an order are shown as pending when you confirm it and are added to your balance only when the order is completed; they are not added for orders that are refused, cancelled or could not be completed. If a completed order is later cancelled, the points earned on it are removed from your balance (never below zero).
8.2 Each point is worth 0.01 JOD and can be used as payment toward an order, up to the amount due. Points used on an order that is later refused, cancelled or could not be completed are not returned. Points are not cash, cannot be withdrawn, and cannot be transferred to another person.
8.3 Bayatoo Credit (if any) is an in-app balance that can only originate from your own points; it is usable only on Bayatoo orders, is not cash and cannot be withdrawn or transferred.
8.4 We set and may adjust earning rates, share rewards and redemption rules. Changes apply going forward and do not alter points already credited.
8.5 Abuse (fake accounts, self-referral, automated or fraudulent share activity, fraudulent orders) may result in forfeiture of points and account suspension.
9. Referral System v1
9.1 You may share Bayatoo only through channels we enable (v1: WhatsApp, Messenger, Instagram).
9.2 Share messages must not misrepresent Bayatoo as a get-rich or cash program. Our official invite text is a friend recommendation, not a rewards advertisement to the recipient.
9.3 When a new user registers with your invite link or code, the sign-up is linked to your account and shown to you. Referral sign-ups do not earn Bayatoo Credit or any other reward unless we announce a program that says otherwise.
9.5 Codes. Bayatoo may issue codes to selected people. A valid, active code entered on an order applies the discount stated for that code to that order only. Codes can be deactivated at any time; a deactivated or invalid code cannot be used on new orders.
9.4 We may withhold or reverse program benefits in cases of fraud or policy breach.
10. Notifications
10.1 We may send order-related notifications (e.g. quote ready, need information, shipped, delivered, cancelled).
10.2 We do not treat notifications as a marketing spam channel under our MVP product policy.
10.3 You can disable system notifications in device settings; essential service messages may still appear in-app.
11. Acceptable use
You agree not to:
- Submit illegal, prohibited, or fraudulent product requests
- Impersonate others, or abuse accounts and password resets
- Interfere with the service or other users
- Reverse engineer for unauthorized competing use of non-public systems beyond what law allows
- Use referrals or credits to game the system
We may suspend or terminate accounts that violate these Terms.
12. Intellectual property
Bayatoo branding, app UI, and our content are owned by us or licensors.
Third-party store names and product content remain their property; use of links is for fulfillment of your request.
13. Disclaimers
13.1 The service is provided on a commercially reasonable basis.
13.2 We are not responsible for third-party storefront content, sudden stock changes, or third-party app outages.
13.3 To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages (including lost profits or data) arising from use of the service.
13.4 Our total liability related to an order is limited to amounts you paid to us for that order (excluding third-party or shipping components already consumed), except where liability cannot be limited by law (e.g. fraud or willful misconduct).
14. Indemnity
You agree to indemnify Bayatoo against claims arising from your misuse of the service, inaccurate order information, or unlawful product requests, to the extent permitted by law.
15. Governing law and disputes
These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without prejudice to mandatory consumer protections.
Disputes shall be subject to the competent courts of Jordan, unless mandatory rules require otherwise.
16. Changes
We may update these Terms. Continued use after the effective date of changes constitutes acceptance where permitted. Material changes should be indicated by version/date on https://bayatoo.com and/or in-app.
